Lucy Koh أصدرت قرارها اليوم في محكمة ولاية سان خوسيه الفيدرالية بمنح Apple الحق بأخذ عينات من أجهزة Samsung الحالية أو الجديدة و أداوت التسويق التي قد تستخدم في تلك الحملات لمتابعة المنتجات و معرفة تشابهها مع منتجات Apple القادمة في قطاع الهواتف أو الأجهزة اللوحية.
الغريب أن القرار الذي صدر لن يجعل لـApple الوصول المباشر للمنتجات و لكن سيكون بمقدور “أعين إستشارية خارجية فقط” كما ذكرت القاضية في حكمها فعل ذلك. الأن أمام Samsung ثلاثين يوم فقط لتسلم تلك المنتجات للقاضية قبل الوصول إلى عقوبات و قرارات أخرى قد تصدر،

In particular, the design and appearance of Samsung’s forthcoming products and packaging are directly relevant to Apple’s trademark, trade dress, and design claims. Because these claims are subject to consumer confusion and “ordinary observer” standards, the products themselves and the packaging in which they are sold are likely to be central to any motion for preliminary injunction
